General Terms and Conditions (GTC) of Stimio GmbH for consumers

1. Scope

These General Terms and Conditions (GTC) apply, in the version valid at the time of the order, to all contracts concluded via the online shop www.stimio.com between Stimio GmbH (hereinafter "Seller") and consumers. The GTC are available for download and printing on the website at any time.

2. Conclusion of contract

You can order our products by phone or through our online shop. For phone orders without specifying a payment method, delivery is usually cash on delivery.

Our offers in the webshop are non-binding. By clicking the "Order with payment" button, you submit a binding offer to purchase the goods in your shopping cart. The purchase contract is concluded as soon as you receive an order confirmation from us or we ship the goods to you.

We only accept orders in household quantities. Any password required for an order may not be shared with third parties; otherwise, you will be liable for any resulting orders.

3. Delivery

Deliveries will be made within five business days of receipt of payment (in advance payments) or after conclusion of the contract (for other payment methods). Deliveries within Germany generally take one to three business days.

We will notify you immediately of any delivery delays. Partial deliveries are permitted, provided they are reasonable for you. You will not incur any additional shipping costs. If delivery is not possible through no fault of our own, we reserve the right to withdraw from the contract.

4. Right of withdrawal

Consumers have a statutory right of withdrawal. The cancellation policy and the sample cancellation form can be found at the end of these Terms and Conditions.

Note on limited right of withdrawal:

Please note that the right of withdrawal expires prematurely for sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (e.g., in the case of opened spray bottles). Returns of such items are excluded.

5. Prices

All prices are in euros and include VAT. Shipping costs are listed separately under Section 6.

6. Shipping costs

Shipping is free within Germany. Cash on delivery costs €4.95. Please note that additional fees may be charged by the shipping company for cash on delivery orders.

7. Terms of payment

Payment options include advance payment, PayPal, credit card, instant bank transfer, and cash on delivery. Further details on payment service providers such as Klarna and Payolution can be found on our website.

8. Warranty

Statutory warranty rights apply. Please enclose the invoice for any complaints.

9. Care and usage instructions

Please follow all care, storage, and usage instructions provided on the products. Products such as dietary supplements are not a substitute for a balanced diet.

10. Retention of title

The goods remain our property until full payment has been made.

11. Data protection

12. Liability

We are liable without limitation for intentional misconduct and gross negligence, as well as for injury to life, body, or health. In the case of slightly negligent breaches of essential contractual obligations, we are only liable for foreseeable damages.

13. Product images

Product images may differ from the delivered item, as long as this is reasonable for the customer.

14. Choice of law and place of jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers residing in other EU countries may enjoy additional protection under the mandatory law of their country of residence. The place of jurisdiction for merchants is Nuremberg.

15. Dispute resolution

The EU Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr/ We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Cancellation policy

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period begins on the day on which you or a third party designated by you takes possession of the goods. To exercise your right of withdrawal, you must inform us of your decision by means of a clear declaration (e.g., email or letter). A sample form can be found on our website.

Exclusion or premature expiry of the right of withdrawal:

The right of withdrawal does not apply to:

• sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed (e.g. spray bottles);

• custom-made or personalized items;

• perishable goods.

In the event of an effective cancellation, we will refund all payments within 14 days of receipt of the goods or proof of return being provided.

You will bear the direct costs of returning the goods.
